Terms of Service

1. Agreement to Terms

By accessing and using the services of Portland Porta Potties PotFlexi, you accept and agree to be bound by these Terms of Service. These terms apply to all visitors, users, and customers who access or use our portable toilet rental services, website, and related offerings.

If you do not agree with any part of these terms, you may not use our services. We reserve the right to update, change, or replace any part of these Terms of Service by posting updates on our website. Your continued use of our services following the posting of any changes constitutes acceptance of those changes.

2. Services Provided

Portland Porta Potties PotFlexi provides portable sanitation equipment rental services, including but not limited to:

  • Standard and deluxe portable toilet rentals
  • ADA wheelchair accessible portable toilet rentals
  • Restroom and shower trailer rentals
  • Handwashing station rentals
  • Portable toilet delivery, setup, servicing, and removal
  • Waste pumping and disposal services

All services are subject to availability and are provided in the Portland, Oregon metropolitan area and surrounding cities as specified in our service area documentation.

3. Rental Agreements and Reservations

All equipment rentals require a written rental agreement specifying the rental period, number of units, service frequency, pricing, and other terms. Reservations may be made by phone at (971) 314-8380 or through our website.

Rental agreements become binding once confirmed by Portland Porta Potties PotFlexi. We recommend booking at least 48 hours in advance for small orders and 1-2 weeks in advance for orders of ten or more units, particularly during peak season.

Changes to existing reservations must be made at least 24 hours before the scheduled delivery date. Late changes may incur additional fees.

4. Pricing and Payment Terms

All prices are quoted in US dollars and are subject to change without notice. Your rental agreement will specify the total cost, including delivery, servicing, and removal fees. There are no hidden fees, and all charges are itemized in your agreement.

Payment is due according to the terms specified in your rental agreement. We accept major credit cards, checks, and electronic transfers. For recurring or long-term rentals, invoices will be issued according to the agreed billing schedule.

Late payments may result in suspension of service and additional late fees. Returned checks will incur a processing fee.

5. Delivery, Placement, and Site Access

Customer is responsible for providing clear, level ground access for delivery and placement of equipment. Delivery areas must be free of overhead obstructions, utilities, and hazards that could prevent safe placement.

If our delivery personnel determine that site conditions are unsafe or unsuitable for equipment placement, we reserve the right to refuse delivery until conditions are corrected. No refund will be issued for delivery delays caused by inadequate site preparation.

Customer must ensure that our service vehicles can access the site during scheduled service visits. Locked gates, barriers, or unsafe conditions that prevent service will result in missed service charges.

6. Customer Responsibilities

Customers agree to:

  • Use equipment only for its intended sanitary purpose
  • Prevent vandalism, theft, or intentional damage to rental equipment
  • Ensure site access for service and pick-up visits
  • Not relocate or move equipment once placed without prior authorization
  • Report damage, malfunction, or service issues promptly
  • Not dispose of prohibited materials (chemicals, construction debris, medical waste, etc.) in portable toilets
  • Comply with all local health, safety, and sanitation regulations

Failure to meet these responsibilities may result in additional fees, service suspension, or termination of the rental agreement.

7. Equipment Damage and Loss

Customer is responsible for equipment from the time of delivery until pick-up. Any damage beyond normal wear and tear, vandalism, theft, or loss will be charged to the customer at replacement cost.

Customers must notify Portland Porta Potties PotFlexi immediately if equipment is stolen, vandalized, or damaged. We will work with customers to file police reports and insurance claims when applicable.

Portland Porta Potties PotFlexi is not responsible for damage to customer property caused by site conditions, underground utilities, or other hazards not disclosed by the customer prior to delivery.

8. Service Schedule and Maintenance

Scheduled service visits include waste pumping, interior cleaning, supply restocking, and equipment inspection. Service frequency is specified in your rental agreement and typically occurs weekly or biweekly.

Emergency or additional service visits may be requested and will be charged separately. We make every effort to accommodate service requests but cannot guarantee same-day availability.

Service may be delayed or rescheduled due to weather conditions, site access issues, or other circumstances beyond our control. We will make reasonable efforts to notify customers of service delays.

9. Cancellation and Refund Policy

Cancellations made more than 48 hours before the scheduled delivery date will receive a full refund of any deposits or prepayments, minus a $50 administrative fee.

Cancellations made within 48 hours of delivery or after equipment has been delivered are subject to the full rental fee. No refunds will be issued for early termination of rental agreements unless approved by Portland Porta Potties PotFlexi management.

Weather-related cancellations initiated by the customer are subject to standard cancellation terms. Portland Porta Potties PotFlexi may cancel or reschedule deliveries due to severe weather without penalty.

10. Limitation of Liability

Portland Porta Potties PotFlexi liability is limited to the rental fees paid by the customer for the affected rental period. We are not liable for indirect, incidental, consequential, or punitive damages arising from equipment use, service delays, or equipment malfunction.

We do not guarantee that equipment will be available for use at all times. Equipment may occasionally require maintenance, repair, or replacement. We will make reasonable efforts to address issues promptly but are not liable for damages resulting from temporary unavailability.

Customer assumes all risk of injury or property damage resulting from improper use, site conditions, or failure to follow safety guidelines.

11. Indemnification

Customer agrees to indemnify and hold harmless Portland Porta Potties PotFlexi, its employees, agents, and representatives from all claims, damages, losses, and expenses (including legal fees) arising from customer's use of equipment, site conditions, or violation of these Terms of Service.

This indemnification obligation survives termination of the rental agreement.

12. Insurance and Compliance

Portland Porta Potties PotFlexi maintains general liability insurance and complies with all applicable federal, state, and local regulations governing portable sanitation services, including OSHA requirements and waste disposal regulations.

Customers are responsible for ensuring their use of rental equipment complies with all applicable permits, zoning requirements, and health codes for their specific site and event type.

13. Intellectual Property

All content on the Portland Porta Potties PotFlexi website, including text, graphics, logos, images, and software, is the property of Portland Porta Potties PotFlexi or its licensors and is protected by copyright and trademark laws.

You may not reproduce, distribute, modify, or create derivative works from any website content without express written permission from Portland Porta Potties PotFlexi.

14. Privacy and Data Collection

Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using our services, you consent to our data collection and use practices as described in the Privacy Policy.

We collect contact information, delivery addresses, payment details, and service history necessary to provide rental services. We do not sell or share your personal information with third parties except as required to fulfill services or comply with legal obligations.

15. Governing Law and Dispute Resolution

These Terms of Service are governed by the laws of the State of Oregon, without regard to conflict of law principles. Any disputes arising from these terms or your use of our services will be resolved in the state or federal courts located in Multnomah County, Oregon.

Before initiating legal proceedings, parties agree to attempt resolution through good faith negotiation. If negotiation fails, disputes may be submitted to binding arbitration in Portland, Oregon, under the rules of the American Arbitration Association.

16. Severability

If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

17. Entire Agreement

These Terms of Service, together with your rental agreement and our Privacy Policy, constitute the entire agreement between you and Portland Porta Potties PotFlexi regarding the use of our services. These terms supersede any prior agreements or understandings.
